Conditions

In these terms and conditions, the term "Hebor watersports" means. These general terms and conditions apply to all legal acts of Hebor water sports, as well as to the agreement (s) concluded between Hebor watersports and the Client, regardless of the place of residence or location (s) of the parties involved in that agreement and irrespective of the place where that agreement came about or must be implemented. Deviations from these general terms and conditions are only valid if expressly agreed in writing. Terms and Conditions of Client are only applicable if and insofar as agreement has been reached in writing with Hebor watersports. If (a) provision (s) of these general terms and conditions is null and void or is / become void, the other provisions of these general terms and conditions will remain in full force and Hebor watersports and Client will consult in order to (a) new provision ( and) to agree to replace the null and void or nullified provision (s), whereby the purpose and intent of the void or nullified provision (s) will be taken into account as much as possible. Offer and agreement All offers are without obligation, even if they contain a term of acceptance. If a free offer is accepted by the Client, Hebor watersport has the right to revoke this offer within five working days after receipt of the acceptance. An agreement is concluded between Hebor watersports and the Client if they accept an offer from Hebor water sports on-line, by e-mail or by fax or otherwise. As a rule, Hebor water supply will take place within 14 days after approval of the customer by the operator concerned, provided products are available in stock from suppliers. Although Hebor watersport will exercise the necessary care when formulating his offers, including price lists and other information that may indicate (any) legal relationship between Hebor watersports and the other party, the Client can never have any legitimate expectation regarding this. to derive the accuracy of the data contained therein, unless expressly agreed otherwise in writing. All images, drawings, data concerning weights, dimensions, colors, etc. are only approximate. Deviations from reality can not be a reason for compensation and / or dissolution.

Prices, rates and payment

The prices and rates indicated by Hebor watersport in an offer / order confirmation are subject to change and apply exclusively to the performances or scope of delivery stated in the offer / order confirmation. All prices for the offered goods are (unless otherwise indicated) in euros and including VAT and other levies imposed by the government. The shipping costs are exclusive, unless expressly agreed otherwise. Hebor watersport reserves the right to change its prices and rates. Client is entitled to cancel an order or to dissolve the agreement with immediate effect within seven (7) days after the notification of Hebor watersport of the price increase. If during the term of the agreement a change occurs in the costs of Hebor water sports, as a result of any provision in a collective labor agreement, law, decision or order of (semi) government (including foreign governments) of mandatory legal nature, or if outside the sphere of influence of Hebor watersport such cost-increasing circumstances occur that in reasonableness of Hebor water sports can no longer be required that the agreed price is used, the Client hereby already agrees now for then to a change of that price, which by Hebor water sports to the Client will be communicated further by the indication of objective criteria. Hebor watersport reserves the right to cancel orders from the client, if the payment is not received within 7 days after order date.

Delivery, delivery times and transport

The delivery time stated by Hebor watersport (possibly) can never be considered as a deadline. Exceeding a delivery time can never lead to compensation or any other action towards Hebor water sports, unless otherwise agreed and except in case of intent or gross negligence on the part of Hebor water sports. Hebor watersport reserves the right to deliver and invoice ordered items in partial shipments. If the Client does not grant her necessary cooperation to comply with the obligation by Hebor watersports or if another impediment arises from her side, the agreement can be terminated within eight days after the Client has been declared in default by Hebor watersport, or terminated without judicial intervention being required and without prejudice to the right of Hebor watersport to claim compensation from the Client for loss and / or lost profits. In addition, if and as long as the foreclosure caused by the Client in the fulfillment by Hebor watersports continues, the Client of Hebor water sports can not claim fulfillment while Hebor watersport is entitled to demand from the Client reimbursement of costs reasonably incurred, resulting from the behavior described in this paragraph or the negligence of the Client. Unless otherwise agreed in writing, the mode of transport, shipping, packaging and the like will be determined by Hebor water sports, without Hebor watersport having any liability for this. If within 30 days the ordered goods are not delivered without informing the client, the order can be canceled free of charge.

Force majeure and / or special circumstances

Force majeure means a shortcoming that Hebor water sports can not be attributed to because it is not due to his fault, nor under law, legal act or generally accepted for his account, including the case, that Hebor water sports by one ( attributable) shortcoming or carelessness of third parties is unable to perform his services. Force majeure includes, among other things: business disruption or business interruptions of any nature, and indifferent in what way arise; delayed or late delivery by one or more suppliers of Hebor water sports; transportation difficulties or obstacles of any kind, which prevent the transportation to Hebor water sports or from Hebor water sports to the Client is impeded or impeded. Hebor watersport has the right to invoke force majeure, if any circumstance prevents (further) fulfillment. During the period of force majeure, the obligations of Hebor water sports will be suspended. If the period of suspension lasts longer than thirty days, both parties are entitled to dissolve the agreement in whole or in part, without there being any obligation to pay compensation in that case. If Hebor water sports at the onset of the force majeure already partially fulfills its obligations, Hebor watersport is entitled to invoice the already delivered or exported or the deliverable or executable part separately, and the Client is obliged to pay this invoice as if it concerned a separate agreement. .

Reservation of ownership

The ownership of the delivered goods is explicitly reserved by Hebor watersport until full payment has been made. This includes the reimbursement of all costs and interest, including earlier and later deliveries and services rendered, as well as claims for damages due to shortcomings in the performance.

Risks

The risk of loss or damage to items that are the subject of the agreement is transferred to Client at the time of delivery to the address specified by the Client.

Complaints, liability and return shipment

The Client has the obligation to investigate whether the goods meet the agreement upon delivery. Any complaints about a product delivered by Hebor watersports must be promptly communicated to Hebor watersport by the Client in writing and with motivation within 5 working days after delivery by e-mail or in writing. If this term is exceeded, the right to complain will lapse. After the expiration of the aforesaid term, Hebor watersport is deemed to have fulfilled its obligations correctly, and it is assumed that the Client has received the items in good order, subject to proof to the contrary by the Client. If the Client proves that the items do not comply with the agreement, Hebor watersport has the choice to replace these items with new items or to refund the invoice value. If the Client does not wish to purchase a product for whatever reason, the Client has the right to return the product to Hebor watersport within 14 (fourteen) working days after delivery. Return shipments are only accepted in this case if the packaging of the product is undamaged and the packaging is not broken, and also that all shipping costs are for Client's account. Hebor watersport accepts returned goods, as mentioned in article 8.2 and article 8.3 only if and insofar as they have agreed in writing with this return, by e-mail, and then only when these items to the address to be specified by Hebor watersport are delivered in the original packaging and in the condition in which Hebor watersport delivered these items to the Client. Within 14 (fourteen) days after receiving the return shipment, Hebor Watersport will refund the relevant amount to the customer.

Guarantee

Hebor watersport commits to comply with all provisions of the manufacturer's warranty for the delivered goods. For example, all products have a minimum factory warranty of 1 year. Without prejudice to what has been described above, the Client can not invoke the aforementioned guarantee provisions: if the Client has made or has made changes to the goods, among which also - are repairs not carried out by or on behalf of Hebor water sports; if the errors are wholly or partially the result of incorrect, careless or inexpert use; if the faults have occurred as a result of lightning, fire or water damage, or by other external causes or disasters; if the Client has neglected the items; if the Client has handled the items negligently in a different way, or has treated them in such a way that the risk to traffic views must be borne by the Client.

Personal data

Personal data entered by Client will be included in a file for use only for the execution of Client's order. Client data will be included in a central file of Hebor water sports and will only be used to keep Client fully up-to-date with regard to the business and services of Hebor water sports, unless Client has indicated that it does not require any price. The Client's data will be processed in accordance with applicable laws and regulations. The client can, if desired, obtain access to the data recorded by Hebor watersport about the person of the Client in the file of Hebor watersports. Client is entitled to request changes to the data if this data is not correct.

Miscellaneous

If the Client gives an address to Hebor watersport in writing, Hebor watersport is entitled to send all orders to the address in question, until Client Hebor watersport has given a new address. If Hebor watersports allow for deviations from these conditions, whether or not tacitly, for a short or longer period, this shall not affect its right to demand immediate and strict compliance with the Conditions. Client can never assert any right on the grounds that Hebor watersport applies these Conditions smoothly. Hebor watersports is authorized to use third parties in the execution of the order (s). Applicable law and disputes regulation Dutch law applies to all offers, orders and agreements of Hebor watersports. Disputes between Hebor watersport and Client will be submitted to a competent judge in the district of Rotterdam.
